Welcome to 3daily.ai.

These Terms of Service govern your access to and use of the website, platform, products, services, tools, and related offerings made available by My3dSelfie, Inc., doing business as 3DAILY / 3daily.ai. In these Terms, the terms we, us, and our refer to 3daily.ai and/or its operating entity.

Our Services may be powered in part by Shopify and other third-party infrastructure providers. By visiting, accessing, browsing, using, or purchasing from our Services, you agree to be bound by these Terms, as well as our Privacy Policy, Refund Policy, Shipping Policy, and any other policies referenced on our website.

If you do not agree, you should not use our Services.

1. Eligibility and Account

By using our Services, you represent that:

  • you are at least the age of majority in your place of residence, or you have the necessary authority and consent to use the Services;
  • all information you provide is accurate, current, and complete;
  • you are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

You may not transfer, sell, assign, or sublicense your account without our prior written permission.

2. Nature of Our Services

3daily.ai provides a combination of:

  • instant AI-generated or platform-generated digital outputs;
  • credit-based or prepaid platform features;
  • production-ready digital custom products involving AI tools and human artist input;
  • custom physical products based on customer-selected or customer-specific designs, models, or outputs;
  • related tools, previews, customizations, and services.

Some outputs are instant previews or early-stage digital results and may not be production-ready. Some products involve artist refinement, technical optimization, platform-specific adjustments, or made-to-order physical production.

3Customer Inputs and Uploaded Content

You may upload, submit, transmit, or otherwise provide content to us, including photographs, prompts, references, text, artwork, likenesses, character materials, logos, brand assets, and other materials (collectively, Customer Content).

3.1 Your representations and warranties

You represent and warrant that:

  • you own or control all rights necessary to provide such Customer Content;
  • your Customer Content does not infringe any intellectual property, privacy, publicity, contractual, or other rights of any third party;
  • where your Customer Content depicts any individual (including yourself), you have obtained all necessary consents from that individual to upload, process, and use the content for the purposes described in these Terms;
  • you will not upload Customer Content depicting minors except where you are the parent or legal guardian of that minor and you authorize such use;
  • your Customer Content does not depict any identifiable public figure, celebrity, or other person whose likeness is protected by right of publicity, unless you have obtained their explicit written consent;
  • your Customer Content is lawful and does not violate these Terms.

3.2 License grant to us

By submitting Customer Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, host, store, copy, modify, process, adapt, transmit, reproduce, create derivative works of, and display that Customer Content for the purposes of operating, providing, supporting, and fulfilling the Services and your orders, including transmitting Customer Content to our service providers, artist network, AI service providers, and production partners as needed to deliver the requested output.

This license terminates with respect to active processing of new Customer Content when you stop using the Services, except that we may continue to retain copies as needed for record-keeping, legal compliance, dispute resolution, fraud prevention, and similar purposes as described in our Privacy Policy.

3.3 Marketing and showcase use

We may also request your separate, opt-in consent to use specific outputs created from your Customer Content for marketing, promotional, or showcase purposes (for example, in our gallery, on social media, or in advertising). Such marketing use will only occur if you have specifically consented, except where the output is fully anonymized and contains no identifiable likeness.

3.4 Rejected or removed content

We may reject, suspend, remove, or refuse to process any Customer Content that we believe violates these Terms, applicable law, or third-party rights, with or without notice to you.

4Products, Outputs, and Variations

We try to describe and present our products and services as accurately as possible. However:

  • AI-generated outputs may vary
  • instant outputs may not be production-ready
  • artist-assisted outputs may involve interpretation and refinement
  • rendered previews may differ from final digital or physical results

colors, textures, materials, and appearance may vary depending on device settings, materials, manufacturing methods, and production limitations. We do not guarantee that any preview, render, or visual representation will match the final result exactly. Unless expressly stated in writing, we do not guarantee that any output is suitable for a specific third-party platform, engine, marketplace, printer, or commercial purpose.

4.1 Nature of AI-generated outputs

You acknowledge and agree that AI-generated outputs are produced by machine learning systems and that:

  • outputs may sometimes contain inaccuracies, artifacts, distortions, or unexpected elements;
  • outputs may, by coincidence and without intent, resemble third-party works, individuals, or styles;
  • outputs may not be suitable for every commercial use case, particularly where the use depends on specific third-party platform policies (for example, social media platforms, marketplaces, app stores, or content distribution networks);
  • some outputs, especially those involving generated audio or music, may occasionally be flagged by automated rights-management systems on third-party platforms, and such flagging is outside our control;
  • you are responsible for reviewing and evaluating outputs before using them, and for ensuring your use complies with applicable laws and the terms of any third-party platforms on which the output is distributed.

We do not warrant that AI-generated outputs are free from such occurrences or that they will be accepted by any particular third-party platform without restriction.

5. Orders and Acceptance

When you place an order, you are making an offer to purchase. We may accept or reject any order at our discretion. An order is not accepted until we confirm acceptance and successfully process payment.

We may refuse or cancel orders for reasons including:

Your purchases are subject to our Refund Policy and Shipping Policy, as applicable.

6. Credits & Custom Orders

Certain purchases on 3daily.ai are treated differently from standard retail purchases.

  • 6.1 Credits and prepaid usageCredits, tokens, prepaid balances, usage packs, subscriptions, and similar platform purchases are generally non-refundable except where required by law or where a billing error caused by us is confirmed.
  • 6.2 Instant digital outputsInstant digital outputs generated through the platform are generally non-refundable once generated, rendered, displayed, processed, downloaded, or otherwise made available.
  • 6.3 Production-ready digital custom productsThese products are custom-made and often involve AI systems, artist time, internal workflow allocation, and technical refinement. These products are generally non-refundable once work has started.
  • 6.4 Custom physical productsCustom physical products are made to order and are generally non-refundable once production has started.
  • 6.5 CancellationsCancellation requests for custom products must generally be submitted within 24 hours of order placement. A request within 24 hours does not guarantee a full refund. Refunds, if any, depend on whether work, artist allocation, processing, or production has already begun. For full details, please review our Refund Policy.

7. Prices and Billing

Prices, discounts, promotions, and availability may change without notice. Unless otherwise stated, prices do not include taxes, shipping, customs duties, import charges, or similar fees.

You agree to provide accurate, current, and complete billing and payment information and authorize us to charge your selected payment method for all amounts due.

If there is a billing error caused by us, we will investigate and correct it where appropriate.

8. Shipping and Delivery

Delivery timelines are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs, external suppliers, force majeure events, or events outside our reasonable control.

Risk of loss for physical goods passes in accordance with applicable law and the shipping arrangement used for the order.

9Intellectual Property

9.1 Our intellectual property

All rights, title, and interest in and to the Services, including the website, platform, tools, software, interfaces, branding, trademarks, logos, graphics, text, designs, compilations, and related content, are owned by us or our licensors and are protected by applicable intellectual property laws.

Except as expressly permitted, you may not:

  • • copy, reproduce, republish, modify, distribute, or create derivative works from the Services;
  • • scrape, mine, extract, or harvest data, outputs, or content from the Services;
  • • use bots, crawlers, or automated systems to access the Services without our written consent;
  • • reverse engineer, decompile, or attempt to discover source code or underlying models;
  • • use our Services or outputs to train competing AI or machine learning systems unless we expressly allow it in writing.

9.2 Ownership of outputs

Subject to your payment in full of all applicable fees, your continued compliance with these Terms, and any specific restrictions stated at checkout or in related policies, you retain ownership of the digital outputs and physical products created specifically for you through paid orders ("Customer-Specific Outputs"), to the extent such ownership is permitted under applicable law.

For clarity:

  • you may use Customer-Specific Outputs for personal use and, unless otherwise restricted, for general commercial use;
  • we do not claim copyright ownership over your Customer-Specific Outputs, except in respect of any of our pre-existing intellectual property, base assets, templates, rigs, or platform components incorporated into the output, which remain owned by us or our licensors and are licensed to you on a non-exclusive basis solely for your use of the Customer-Specific Output;
  • where any third-party AI service provider, asset library, or licensed component is incorporated into the output, additional terms from those upstream providers may apply, and you agree to comply with such terms;
  • some outputs may include or display attribution marks, watermarks, or technical metadata that we or our upstream providers reasonably require, and you agree not to remove such markings unless we expressly permit it;
  • you may not use Customer-Specific Outputs in a way that violates the rights of any third party, applicable law, or these Terms.

We reserve the right to use Customer-Specific Outputs internally for record-keeping, dispute resolution, security, abuse prevention, and similar purposes, and for marketing or promotional purposes only with your separate consent as described in Section 3.3.

9.3 Free or unpaid usage

If you use any free, trial, beta, or unpaid features of the Services, ownership of outputs generated through such use is governed by the specific terms of the relevant feature, which may differ from Section 9.2. In the absence of specific terms, free or unpaid outputs are licensed to you for personal, non-commercial use only.

10. Third-Party Tools & Links

The Services may include third-party tools, embedded functionality, integrations, or links to third-party websites. We provide these on an as-available basis and are not responsible for their content, availability, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

11. Relationship with Shopify

3daily.ai may be powered by Shopify, which enables us to provide parts of the Services to you. However, any sale or purchase you make through our store is made directly with us, not with Shopify. To the extent permitted by law, Shopify is not responsible for any aspect of any sales between you and us.

12. Privacy

Your use of the Services is subject to our Privacy Policy. Because parts of the Services may be hosted or enabled by Shopify and other service providers, including AI service providers, your information may also be processed by such providers in accordance with their own applicable policies. 13. Feedback

If you provide feedback, suggestions, ideas, reviews, or recommendations, you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display that feedback for any lawful purpose, without compensation to you.

14. Prohibited Uses

You may not use the Services:

  • ✕ for unlawful, fraudulent, misleading, or abusive purposes;
  • ✕ to infringe intellectual property, privacy, publicity, or other rights;
  • ✕ to upload unlawful, offensive, or prohibited content;
  • ✕ to harass, defame, threaten, or impersonate others;
  • ✕ to transmit malware, malicious code, or disruptive materials;
  • ✕ to scrape, crawl, extract, or systematically collect data from the Services;
  • ✕ to bypass security, rate limits, access restrictions, or anti-bot measures;
  • ✕ to use outputs or platform access in violation of applicable laws or third-party rules;
  • ✕ to submit content that you do not have the right to use.

14.1 AI-specific prohibitions

In addition to the above, you may not use the Services to create, generate, or distribute content that:

  • depicts identifiable individuals (including public figures, celebrities, or private persons) without their explicit consent, particularly in contexts that could mislead viewers about the individual's actions, statements, or affiliations;
  • constitutes non-consensual intimate imagery, sexually explicit content, or content sexualizing real individuals without their consent;
  • depicts minors in sexual, suggestive, or otherwise inappropriate contexts;
  • is intended to create deceptive, fraudulent, or misleading content (including political deepfakes, forged identities, or manipulated media designed to mislead);
  • incorporates copyrighted characters, branded intellectual property, trademarks, or licensed media without authorization from the rights holder;
  • promotes hate, extremism, violence, terrorism, self-harm, or illegal activity;
  • is intended to harass, intimidate, defame, or stalk any individual.

We may suspend or terminate access if we believe you violated these Terms. We may also report suspected violations to law enforcement and cooperate with lawful investigations.

15. Agent and Automated Access

No automated agent, scraper, bot, or semi-autonomous system may access or interact with the Services except as expressly permitted by us. We may use technical or contractual measures to limit or block such access.

16. Termination

We may suspend, restrict, or terminate your access to the Services at any time, with or without notice, if we believe you violated these Terms, created risk for us or others, or engaged in misuse of the platform. Provisions that by their nature should survive termination will survive.

Legal Disclaimers & Liability

17. Disclaimer of Warranties

To the fullest extent permitted by law, the Services and all products and outputs are provided on an as-is and as-available basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that:

  • the Services will be uninterrupted, secure, or error-free;
  • outputs will meet your subjective expectations;
  • any output will be error-free, production-ready, or commercially usable unless expressly stated;
  • any physical result will perfectly match a preview or render;
  • AI-generated outputs will be free from inaccuracies, artifacts, coincidental resemblances, or platform-specific compatibility issues.

18. Limitation of Liability

To the fullest extent permitted by law, we and our affiliates, officers, employees, contractors, licensors, service providers, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, business, goodwill, opportunity, or data arising out of or related to your use of the Services or any products or outputs.

To the fullest extent permitted by law, our total liability for any claim relating to the Services will not exceed the amount paid by you to us for the specific product or service giving rise to the claim.

19. Indemnification

You agree to indemnify, defend, and hold harmless us, our affiliates, service providers, partners, and licensors from and against claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of:

  • your breach of these Terms;
  • your Customer Content or submissions, including any claim that your Customer Content infringes intellectual property rights, rights of publicity or privacy, or other rights of any third party;
  • your use of any output, including but not limited to claims arising from your distribution of outputs that incorporate copyrighted characters, trademarks, celebrity likenesses, brand assets, or other protected materials uploaded or referenced by you;
  • your misuse of the Services;
  • your violation of any law or third-party rights or third-party platform terms.

This indemnification obligation survives termination of these Terms and your account.

General Provisions

20. Severability

If any provision of these Terms is found unlawful or unenforceable, the remaining provisions will remain in full force and effect.

21. Waiver and Entire Agreement

These Terms, together with the policies referenced herein, constitute the entire agreement between you and us regarding the Services and supersede prior understandings relating to the same subject matter. Our failure to enforce any provision is not a waiver of that provision.

22. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms without restriction.

23. Governing Law and Jurisdiction

These Terms and any dispute arising out of or relating to these Terms or the Services shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, United States.

23.1 Consumer rights

In some jurisdictions, you may have statutory consumer rights, guarantees, or other remedies provided by law that cannot be excluded, restricted, or modified by contract. Nothing in these Terms is intended to limit or exclude such non-waivable consumer rights, and to that extent only, these Terms apply to you to the fullest extent permitted by applicable law in your jurisdiction.

24. Force Majeure

We will not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from causes outside our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, war, terrorism, civil unrest, government action, labor disputes, internet or telecommunications failures, power outages, cyberattacks, supplier or service-provider failures, or any other event of force majeure.

25. Changes to These Terms

We may update these Terms from time to time by posting the revised version on our website and updating the "Last updated" date.

For non-material changes (such as clarifications, formatting, or minor updates), continued use of the Services after the updated Terms become effective constitutes your acceptance of the revised Terms.

For material changes (such as changes to fees, your rights, our liability, or the scope of how we may use your Customer Content), we will provide reasonable advance notice through the Services, by email, or through other appropriate means before the changes take effect, where required by applicable law.
