These Terms of Service govern your access to and use of the website, platform, products, services, tools, and related offerings made available by My3dSelfie, Inc. , doing business as 3DAILY / 3daily.ai. In these Terms, the terms we, us, and our refer to 3daily.ai and/or its operating entity.

Our Services may be powered in part by Shopify and other third-party infrastructure providers. By visiting, accessing, browsing, using, or purchasing from our Services, you agree to be bound by these Terms, as well as our Privacy Policy, Refund Policy, Shipping Policy, and any other policies referenced on our website. If you do not agree, you should not use our Services.

2. Nature of Our Services

3daily.ai provides a combination of:

instant AI-generated or platform-generated digital outputs;
credit-based or prepaid platform features;
production-ready digital custom products involving AI tools and human artist input;
custom physical products based on customer-selected or customer-specific designs, models, or outputs;
related tools, previews, customizations, and services.

Some outputs are instant previews or early-stage digital results and may not be production-ready. Some products involve artist refinement, technical optimization, platform-specific adjustments, or made-to-order physical production.

3. Customer Inputs and Uploaded Content

You may upload, submit, transmit, or otherwise provide content to us, including photographs, prompts, references, text, artwork, likenesses, character materials, logos, brand assets, and other materials.

You represent and warrant that:

you own or control all rights necessary to provide such content;
your content does not infringe any intellectual property, privacy, publicity, contractual, or other rights of any third party;
your content is lawful and does not violate these Terms.

By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, host, copy, modify, process, transmit, and display that content solely for the purpose of operating, providing, improving, supporting, and fulfilling the Services and your orders.

We may reject, suspend, remove, or refuse to process any content that we believe violates these Terms, applicable law, or third-party rights.

4. Products, Outputs, and Variations

We try to describe and present our products and services as accurately as possible. However:

AI-generated outputs may vary
instant outputs may not be production-ready
artist-assisted outputs may involve interpretation and refinement
rendered previews may differ from final digital or physical results
colors, textures, materials, and appearance may vary depending on device settings, materials, manufacturing methods, and production limitations

We do not guarantee that any preview, render, or visual representation will match the final result exactly.

Unless expressly stated in writing, we do not guarantee that any output is suitable for a specific third-party platform, engine, marketplace, printer, or commercial purpose.

5. Orders and Acceptance

When you place an order, you are making an offer to purchase. We may accept or reject any order at our discretion.

An order is not accepted until we confirm acceptance and successfully process payment.

We may refuse or cancel orders for reasons including:

inaccurate or incomplete information
suspected fraud or abuse
prohibited content
technical issues
unavailability of the product or service
compliance or legal concerns

Your purchases are subject to our Refund Policy and Shipping Policy, as applicable.

6. Credits, Instant Outputs, and Custom Orders

Certain purchases on 3daily.ai are treated differently from standard retail purchases.

6.1 Credits and prepaid usage

Credits, tokens, prepaid balances, usage packs, subscriptions, and similar platform purchases are generally non-refundable except where required by law or where a billing error caused by us is confirmed.

6.2 Instant digital outputs

Instant digital outputs generated through the platform are generally non-refundable once generated, rendered, displayed, processed, downloaded, or otherwise made available.

6.3 Production-ready digital custom products

Production-ready digital custom products are custom-made and often involve AI systems, artist time, internal workflow allocation, and technical refinement. These products are generally non-refundable once work has started.

6.4 Custom physical products

Custom physical products are made to order and are generally non-refundable once production has started.

6.5 Cancellations

Cancellation requests for production-ready digital custom products and custom physical products must generally be submitted within 24 hours of order placement. A request within 24 hours does not guarantee a full refund. Refunds, if any, depend on whether work, artist allocation, processing, or production has already begun.

7. Prices and Billing

Prices, discounts, promotions, and availability may change without notice. Unless otherwise stated, prices do not include taxes, shipping, customs duties, import charges, or similar fees.

You agree to provide accurate, current, and complete billing and payment information and authorize us to charge your selected payment method for all amounts due.

If there is a billing error caused by us, we will investigate and correct it where appropriate.

8. Shipping and Delivery

Delivery timelines are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs, external suppliers, force majeure events, or events outside our reasonable control.

Risk of loss for physical goods passes in accordance with applicable law and the shipping arrangement used for the order.

Any rights in customer-specific outputs, if granted at all, are subject to the specific product terms, order terms, and any restrictions stated at checkout or in related policies.

The Services may include third-party tools, embedded functionality, integrations, or links to third-party websites. We provide these on an as available basis and are not responsible for their content, availability, policies, or practices.

Your use of third-party services is at your own risk and subject to their terms.

11. Relationship with Shopify

3daily.ai may be powered by Shopify, which enables us to provide parts of the Services to you. However, any sale or purchase you make through our store is made directly with us, not with Shopify. To the extent permitted by law, Shopify is not responsible for any aspect of any sales between you and us.

12. Privacy

Your use of the Services is subject to our Privacy Policy. Because parts of the Services may be hosted or enabled by Shopify and other service providers, your information may also be processed by such providers in accordance with their own applicable policies. 13. Feedback

any output will be error-free, production-ready, or commercially usable unless expressly stated;
any physical result will perfectly match a preview or render.

To the fullest extent permitted by law, we and our affiliates, officers, employees, contractors, licensors, service providers, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, business, goodwill, opportunity, or data arising out of or related to your use of the Services or any products or outputs.

To the fullest extent permitted by law, our total liability for any claim relating to the Services will not exceed the amount paid by you to us for the specific product or service giving rise to the claim.

19. Indemnification

You agree to indemnify, defend, and hold harmless us, our affiliates, service providers, partners, and licensors from and against claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of:

your content or submissions;
your misuse of the Services;
